Judge Grants Dismissal of Oregon LNG Challenge to the Army Corps of Engineers

The Daily Astorian reports that a U.S. District Court of Oregon judge has adopted a magistrate judge’s findings and granted the U.S. Army Corps of Engineers’ (ACE) motion to dismiss Oregon LNG’s lawsuit. Oregon LNG filed suit last year to challenge ACE’s easement rights to the land beneath the water on the Skipanon Peninsula in Warrenton, Ore.  The magistrate judge found that Oregon LNG’s challenge was filed after the expiration of the applicable 12-year statute of limitations and, therefore, Oregon LNG was time barred to bring such a claim under federal law and the court lacked subject matter jurisdiction over the suit.
