A magistrate judge at the U.S. District Court of Oregon has recommended granting the U.S. Army Corps of Engineers’ (ACE) motion to dismiss Oregon LNG’s suit seeking a declaration that ACE’s easement rights over land Oregon LNG wants to use to build its LNG import/export terminal near Warrenton, Ore. is invalid. The judge found that the suit was filed after the expiration of the applicable 12-year statute of limitations and, therefore, the court lacked jurisdiction over the suit. The recommendation was referred to a district judge and is subject to the filing of objections.
