Federal Appeals Court Reverses Ruling in Passamaquoddy Tribe Case

A three-judge panel of the 1st U.S. Circuit Court of Appeals found that Nulankeyutmonen Nkihtaqmikon (“We Protect Our Homeland”), a group of the Passamaquoddy tribe that opposed their tribe’s leasing land to Quoddy Bay LLC for development into a LNG import terminal, has legal standing to sue the U.S. Bureau of Indian Affairs for approving the lease. Additionally, the appeals panel ruled that the claims  were ripe for review even though the terminal has not received FERC approval.
