Environmental Groups File Court Appeal of FERC’s Freeport LNG Export Terminal Orders

Sierra Club and Galveston Baykeeper (together, Groups) have filed a petition for review with the U.S. Court of Appeals for the D.C. Circuit challenging FERC’s orders authorizing construction of the Freeport LNG export terminal on Quintana Island, near Freeport, Texas.  Among other issues, the Groups allege that (1) FERC erred in concluding that the effects of the Freeport LNG project (Project) on induced gas production were outside the scope of the National Environmental Policy Act (NEPA) indirect and cumulative effects analyses, and (2) FERC violated NEPA by “failing to take a hard look at the Project’s air pollution impacts.”
