FERC Determines Pre-Filing Process Not Required for Freeport LNG Re-Export

In a letter issued today, FERC told Freeport LNG that the company’s proposal to modify its facility in order to re-export imported LNG will not be subject to the mandatory pre-filing process  applicable to new LNG terminals. FERC notes that the proposed “change of use of the facility does not appear to involve significant safety considerations that have not been previously addressed.” FERC added that the U.S. Coast Guard has already determined the proposed modifications would “not change or exceed the waterway impacts envisioned in the original Waterway Suitability Assessment which Freeport previously submitted for the existing facility.” FERC’s letter and correspondence regarding the Coast Guard’s determination are available in  the eLibrary system.
