FERC Reissues Authorization for Cove Point LNG Terminal Expansion in Wake of D.C. Circuit Decision

Following a decision in July by the U.S. Court of Appeals for the District of Columbia Circuit vacating the orders authorizing the Cove Point Expansion Project, FERC reissued its authorization for the construction and operation of the LNG terminal expansion this morning. The Commission’s order, available in the FERC eLibrary under Docket No. CP05-130, found that construction and operation of the Cove Point Expansion is in the public interest and can continue without causing unsafe leakage on Washington Gas Light’s (WGL) distribution system. The order on remand conditions the authorizations on limiting deliveries of imported LNG from the Cove Point Pipeline into Columbia Gas Transmission’s interstate pipelines to existing delivery volumes. The Commission found this would protect WGL from receiving additional volumes of regasified LNG.
