Safe Harbor Investors Ask Court to Reject MARAD Decision

Atlantic Sea Island Group (ASIG) has sued MARAD in the Federal District Court for the District of Columbia over its decision to grant New Jersey “adjacent coastal state” status in the approval process for the Safe Harbor Energy LNG project. Newsday reports that ASIG chairman Howard Bovers said that even though New Jersey Governor Jon Corzine (D) requested “adjacent coastal state” status, the governor is not necessarily opposed to the project, but wants a voice in the process. Under the federal Deepwater Port Act, “adjacent coastal state” governors have the power to veto projects or impose licensing conditions. Bovers said he will continue to seek approval for the terminal even if he loses in federal court, adding “We hope we can negotiate a settlement with the governor.”
