Special Master Hears Arguments in Jurisdictional Dispute Between Delaware and New Jersey

Special Master appointed by the U.S. Supreme Court heard arguments yesterday over whether Delaware has the legal authority to block BP’s Crown Landing LNG terminal. BP has proposed to site the terminal on the New Jersey side of the Delaware River, but a pier associated with the facility would enter territory subject to Delaware’s jurisdiction. Counsel for New Jersey asserted that a 1905 agreement between the states gives New Jersey authority to control improvements on its side of the river, while Delaware contended that a 1934 treaty extends its authority over the area at issue.  It is unclear when the Special Master will make his recommendations to the Supreme Court. The Courier-Post has further details.
