Decision on Motion for Retrial in Pelican Island Case Expected This Week

A Texas judge yesterday heard arguments in a motion to retry a Galveston resident’s challenge to BP’s lease agreement with the Galveston, Texas, Wharves Board of Trustees. Plaintiff Nancy Saint-Paul argued that the entire lease agreement for BP’s proposed Pelican Island terminal is “irreparably tainted,” and that Judge John Ellisor should reconsider the portion of his ruling that upheld a lease ratified at the second of two public meetings. Ellisor’s ruling invalidated an agreement ratified at the first meeting because of inadequate public notice.
