Op-ed: Energy Policy Act Preserved Role of States in Terminal Review Process

Bryan Lee, the director of press services for FERC, clarifies that the enactment of the Energy Policy Act of 2005 did not diminish the important role that state authorities play in the LNG terminal review process. “Regardless of the commission’s action under its Natural Gas Act jurisdiction, no LNG or gas pipeline project can proceed without state agencies’ exercising their federally delegated authority under the U.S. Coastal Zone Management Act, the Clean Air Act or the Clean Water Act,” he said. His op-ed responds to an Oct. 28 letter written by an Old Saybrook, Conn., resident, who said that Congress granted too much authority to FERC in the siting process.
