Commerce Dismisses Second Weaver’s Cove CZMA Appeal
The Secretary of Commerce last week rejected a second request for a determination that the Weaver’s Cove LNG terminal is consistent with the Coastal Zone Management Act. The Secretary dismissed Weaver’s Cove’s appeal, explaining that “[t]he plain meaning of the term ‘appeal’ requires a state objection as a necessary predicate for an appeal to the Secretary.” Rhode Island has not formally objected to the project because, it maintains, Weaver’s Cove’s consistency certification is incomplete. The Secretary’s letter to Weaver’s Cove reporting its decision was posted in the FERC e-Library yesterday in Docket No. CP04-36.
